TERMS AND CONDITIONS FOR 2021 MERCEDS-AMG AND MICHELIN DRIVING EXPERIENCE COMPETITION CONDUCTED BY SUMITOMO RUBBER SOUTH AFRICA (PTY) LTD TRADING AS BLACKCIRCLES.CO.ZA (“Blackcircles South Africa”), (HEREINAFTER REFERRED TO AS “THE PROMOTER”)

For the period of the Blackcircles South Africa Launch Campaign Promotion, customers and social media followers of Blackcircles South Africa are invited to participate in our competition. 25 Winners will receive a Mercedes-AMG & Michelin driving experience at the Zwartkops Raceway, Pretoria (Gauteng) including return flights and travel to/from JHB/Gauteng to any other region in South Africa, if the winner does not reside in Gauteng

There are 3 ways to enter the competition with 25 “Mercedes-AMG Driving Experience” prizes to be won;

• A Mercedes-AMG Driving Experience will awarded to 10 winners who have Liked, Shared and Commented on any of our Facebook/Instagram promotional posts between the 10^th December 2021 and March 2022
• The first 5 customers who purchase a set (4) of Michelin tyres that are 17inch and above,  between the 10^th December 2021 and 7th April 2022 will be guaranteed a Merceds-AMG Driving Experience
• A Mercedes-AMG Driving Experience will be awarded to 10 winners who have entered the lucky draw by purchasing Michelin tyre/s (Single or multiple) between the 10th December 2021 and 7th April 2022,

Duration of the Competition:

The competition will commence on Wednesday, 10^th December 2021 at 10:00 am and will end 7th April 2022 at 12:00 pm.

To qualify for the promotional competition, you must:

• Be a permanent resident of the Republic of South Africa;
• Be 18 years or older;
• Hold a valid drivers license and identification document;
• Possess a valid email address and/or cell phone number and
• Be a winner of one of the 3 promotional campaigns by completing the required action before the end of the competition period

How to enter the 3 competitions:

• Be one of the first 10 customers to Purchase a set (4) of Michelin tyres that are 17inch and above
• Purchase any Michelin tyre/tyres and stand a chance to win via a luck draw
• Like, Share, Comment on our Facebook and Instagram Promotional Posts and stand a chance to win via a luck draw

Competition Prizes:

• An Mercedes-AMG Driving Experience will awarded to 10 lucky winners who have Liked, Shared and Commented on any of our Facebook/Instagram promotional posts between the 10^th December 2021 and 7th April 2022
• The first 5 customers who purchase a set (4) of Michelin tyres that are 17inch and above,  between the 10^th December 2021 and 7th April 2022 will win a Merceds-AMG Driving Experience
• A Mercedes-AMG Driving Experience will be awarded to 10 winners who have entered the lucky draw by purchasing Michelin tyre/s (Single or multiple) between the 10th December 2021 and 7th April 2022,

Competition Prize Terms:

• The prize is non-refundable and not exchangeable for credit or any other item.
• If a customer enters all 3 competitions by default or by action, a customer can only win once, i.e. one Mercedes-AMG driving experience per person
• All rights in and to the prize will be transferred to the winner directly upon confirmation of win.
• The winner shall accept the prize as is and subject to any terms and conditions of the prize. The prize will under no circumstances be handed over to a third party and will only be handed or transferred directly to the verified prize winner
• Return Flights (South African Residents only) to and from any region in South Africa are only provided to winners who do not reside in Gauteng. - Transport from OR Tambo or Lanseria Airport will be provided to and from Zwartkorps Raceway
• All winners will not be permitted to change the date of the Mercedes-AMG driving experience (6th May 2022)

Prize Details - Mercedes-AMG Driving Experience

• Date 6th May 2022 at Zwartkops Raceway (Full day event)
• Venue, skidpan and track hire
• Management Fee
• Instructor Fee
• AMG Training Vehicles
• Support Staff
• Catering - Arrival tea, coffee, breakfast snacks, lunch ,Water and softdrinks all day
• Name badges
• Buffs
• Return Flights to Zwartskops, Pretoria, Gauteng (South African Residents only) to and from any region in South Africa if the winner is not from Gauteng.

Awarding of the Prize:

The winner will be notified via telephone or e-mail. The winner will be required to sign an acknowledgement of receipt of their prize, if applicable, and will be required to furnish the promoter with their names and identity numbers in terms of the Consumer Protection Act No. 68 of 2008. In the event that the winner cannot be successfully contacted following all reasonable attempts to do so, the Promoter reserves the right to draw another winner in substitution after two (2) working days.

The prizes are not transferable. All rights in and to the prize will be transferred to the winner directly upon receipt of the prize.

Announcement of the Winner

The names of the winner will be announced on the Blackcircles Facebook Page.

COVID-19 regulations and the AMG Driving Academy

Within the AMG Driving Academy, we have prepared our building and cars with step by step process and guidelines with Mercedes-Benz South Africa.

The following will be undertaken in order to protect our clients and staff:

• Full Sanitation of the premises from front to back, this will done on a regular basis.
• Our vehicles will be thoroughly cleansed, sanitized and fogged, it will be done on a daily basis,
• There will be Hand Sanitizers before entering the building and will be used frequently during the course of the day.
• Temperature checks will be done upon entering the building
• Catering will be dealt with differently and packaged for each customer individually.
• You as our AMG Clients will be expected to arrive in a protective mask, whilst practicing and maintaining social distancing.

All our staff have been trained to deal with the rules and regulations within the COVID-19 virus.

We doing our part in health and safety, creating awareness, implementing measures, and boosting confidence within our customers, staff and suppliers to ensure our day runs seamlessly.

Terms and Conditions for event cancellations:

If the event is held during the lock down period and the event date is still in the lockdown period, the event will be moved to another date.

Covid-19 - We realize this situation is overwhelming and it is changing every day, but unfortunately if you are unable to attend due to covid-19 related matters, we are unable to provide you with another date to claim the prize and it will be forfeited.

General Terms :

1.  By entering the Mercedes-AMG and Michelin Driving Experience Competition all participants agree to these terms and conditions
    
2.  The Promoter of the promotional competition is Sumitomo Rubber South Africa (Pty) Ltd, trading as Blackcirlces South Africa
    
3.  All information relating to this promotional competition and published on any promotional or advertising material forms part of these terms and conditions
    
4.  The winner of this promotional competition shall be chosen at the Promoter’s sole discretion
    
5.  In the event of any dispute, the decision of the Promoter will be final and binding on all aspects of this promotional competition
    
6.  The Promoter is not liable for the failure of any technical element relating to this promotional competition that may result in an entry not being successfully submitted~
    
7.  Image Disclaimer: Prize images are for illustration purposes only
    
8.  The Promoter makes no representation, warranty or undertaking whatsoever as to any implied terms and conditions with respect to the prizes in this contest and will not entertain any direct correspondence with anyone in this regard
    
9.  The Promoter, its directors, members, partners, employees, agents, consultants, suppliers, contractors and sponsors assume no liability or responsibility whatsoever for any direct or indirect loss or damage arising from a participant’s participation in this promotional competition and will not entertain any direct correspondence with anyone in this regard
    
10.  The Promoter will publish the winner’s names and photographs in any advertising, promotional, print, point of sale or public relations material
     
11.  The Promoter will use photographs of the winner in perpetuity
     
12.  The Promoter shall have the right to terminate this promotional competition with immediate effect, prior to any draw having taken place
     
13.  Failure to comply with these terms and conditions will result in immediate disqualification of a participant
     
14.  The Promoter reserves the right to amend, modify, change, postpone, suspend or cancel this competition and any prizes (which have not yet been subject to a draw), or any aspect thereof, without notice at any time, for any reason which it reasonably deems necessary
     
15.  Participants hereby indemnify and hold harmless the Promoter, its directors, members, agents, advisors, suppliers, partners, employees, sponsors and consultants to the fullest extent allowed in law, against any claims arising howsoever from their participation in this competition and/or use of the prize
     
16.  These rules shall be governed by the laws of the Republic South Africa
     
17.  If any provision of these rules is found to be invalid or unenforceable by any court of competent jurisdiction, then that provision shall be severed from these rules and shall not affect the validity or enforceability of any remaining provisions
     
18.  It is not intended that any provision of these rules contravenes any provision of the Consumer Protection Act No
     
19.  The Promoter reserves the right in its absolute discretion to disqualify any participant if it has reasonable grounds to believe that a participant has breached any of the terms and conditions, any applicable law (including copyright law) or has otherwise infringed the intellectual property of any other person
     
20.  Each Participant acknowledges and agrees that any failure to comply with the Terms and Conditions could lead to the Promoter disqualifying that person, without the Promoter giving any reason for such disqualification or granting any opportunity for challenge
